LICENCE TO OCCUPY

The Licensee agrees to comply with the following house rules, which form part of this Licence:

An incidental security hold of [incidental security hold] is placed on the Licensee's card via Stripe gateway payments prior to occupancy. No funds are charged unless a claim is made. The hold is released within 7 days of check-out, less any amount reasonably deducted by the Licensor for damage, excess cleaning, missing items, or breach of this Licence.

This Licence to Occupy ("Licence") is made between Kimberley Turner ("the Licensor") and [Guest Name] ("the Licensee"), in relation to the property known as Howqua Hideaway, located at 484 Howqua River Road, Howqua, Victoria 3723 ("the Property").

This is a personal Licence to Occupy the Property for short-term recreational and holiday purposes only. It is not a lease or tenancy agreement and does not grant the Licensee exclusive possession of the Property. The Licensee acquires no interest in the Property beyond the right to occupy it in accordance with this Licence for the Term set out below. This Licence is not subject to the Residential Tenancies Act 1997 (Vic).

The Licence commences at check-in on [check-in] and ends at check-out on [check-out] ("the Term"). The Licensee must vacate the Property in full by the check-out time stated, unless otherwise agreed in writing with the Licensor.

The Property is licensed for occupation by no more than 4 persons at any time. The Licensee must not permit additional persons to stay overnight without the Licensor's prior written consent.

The Licensee agrees to:

• Abide by the house rules set out in this Licence;
• Take care of the Property, its fixtures, fittings and contents;
• Smoke only outdoors at the designated fire pit area, fully extinguish all smoking materials, and not discard them on the ground or in vegetation;
• Not light or maintain any outdoor fire on days of Total Fire Ban, or otherwise contrary to CFA restrictions in force;
• Report any damage or malfunction to the Licensor as soon as practicable;
• Not sublet, assign, or share access to the Property with persons outside the agreed occupancy;
• Leave the Property in a clean and tidy condition, consistent with its condition at check-in;
• Be responsible for the conduct of all persons the Licensee permits onto the Property during the Term.

The Licensor, and any tradesperson, maintenance worker, service technician or emergency service engaged or permitted by the Licensor, may enter the Property during the Term where reasonably necessary to inspect, maintain, repair or service the Property, its grounds, services or equipment, or to respond to a safety, damage or emergency situation.

Except in an emergency, the Licensor will give the Licensee reasonable notice of any such visit and will arrange it at a time chosen to cause as little disruption as reasonably possible. The Licensee must not unreasonably obstruct, delay or refuse that access, and must ensure gates and entry points are accessible and any pets are secured at the arranged time.

The Licensee occupies and uses the Property, including any outdoor areas, fire pit, and equipment, at their own risk. To the extent permitted by law, the Licensor is not liable for any injury, loss or damage suffered by the Licensee or their guests during the Term, except to the extent caused by the Licensor's negligence.

The Licensor may terminate this Licence immediately and require the Licensee to vacate the Property if the Licensee breaches any term of this Licence, including the house rules, exceeds the occupancy limit, or causes damage or nuisance.

This Licence is governed by the laws of Victoria, Australia.
